These Terms of Service ("Terms") govern your use of the Whizsky website and services. By accessing or using Whizsky, you agree to be bound by these Terms. If you do not agree, do not use our platform.

1. Definitions

"Platform" refers to the Whizsky website, APIs, and all related services.
"User" refers to any individual or entity that accesses or uses the Platform.
"Content" refers to text, images, data, reviews, listings, and other materials on the Platform.
"User Content" refers to Content submitted by Users.

2. Account Registration

You must provide accurate, complete, and current information when creating an account.
You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activity that occurs under your account.
You must be at least 16 years old to create an account.
One person or entity may not maintain more than one account without written approval.

3. User Content & Conduct

3.1 Content Ownership

You retain ownership of Content you submit. By posting User Content, you grant Whizsky a worldwide, non-exclusive, royalty-free license to use, display, reproduce, modify (for formatting purposes), and distribute your Content on and through our Platform.

3.2 Content Standards

You agree that User Content will not:

Be false, misleading, defamatory, or fraudulent.
Infringe any third party's intellectual property, privacy, or other rights.
Contain malicious code, spam, or unsolicited promotional material.
Impersonate any person or entity.
Violate any applicable law or regulation.
Contain hate speech, threats, or harassment.

3.3 Reviews

Reviews must reflect genuine firsthand experience with the entity being reviewed.
Fake reviews, paid reviews (without disclosure), or competitor-generated negative reviews are prohibited.
Whizsky reserves the right to remove reviews that violate these standards.

4. Listings & Submissions

Listing submissions are reviewed before publication. Whizsky reserves the right to reject, edit, or remove any listing.
Submitters are responsible for the accuracy of the information provided.
Claiming a listing requires verification of your authority to represent the entity.

5. Premium Subscriptions

Paid plans provide enhanced features as described on our pricing page. Features may change with reasonable notice.
Subscriptions auto-renew unless cancelled before the renewal date.
All fees are listed in the applicable currency and are charged according to your billing cycle.
Refunds are handled pursuant to our Refund Policy.

6. Intellectual Property

The Whizsky name, logo, design, and original content are owned by Whizsky and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary content without written permission.

7. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WHIZSKY DOES NOT WARRANT THAT:

The Platform will be uninterrupted, error-free, or secure.
User Content or listing data is accurate, complete, or reliable.
Any particular results will be achieved through use of the Platform.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHIZSKY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO BUSINESS DECISIONS MADE BASED ON INFORMATION FOUND ON OUR PLATFORM.

9. Indemnification

You agree to indemnify and hold harmless Whizsky and its team from any claims, damages, or expenses arising from your use of the Platform, your User Content, or your violation of these Terms.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Platform ceases immediately.

11. Governing Law

These Terms are governed by the laws of India. Disputes shall be resolved through binding arbitration or in the courts located in Jaipur, Rajasthan, India.

12. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or platform notice. Continued use after changes constitutes acceptance of the new Terms.
